Namma Bengaluru Foundation raises pitch for compensation to BBMP demolition drive victims; writes to Chief Minister of Karnataka

In a bid to draw attention towards the plight of several Bengalureans who have been rendered homeless post the BBMP demolition drive, Namma Bengaluru Foundation (NBF) has written to the Hon’ble Chief Minister of Karnataka Shri. Siddharamaiah and to the Chief Secretary Shri. Aravind Jadhav. The letter highlights the clear need for the Government of Karnataka to take accountability and ownership of the situation by duly compensating the victims. The letter also brought forth some hard hitting facts highlighting the difficulties faced by innocent home buyers due to the criminal nexus between unscrupulous builders and corrupt officials. Along with the letter, NBF also submitted a petition to the Chief Minister, duly signed by 1400 concerned Bengalureans, demanding – no double standards in demolitions; compensation on humanitarian grounds and criminal prosecution against corrupt builders and officials.

Sridhar Pabbisetty, CEO, Namma Bengaluru Foundation said, “On grounds of humanity and as a moral responsibility towards people who have been affected by the demolition drive, Government must take cognizance and provide timely relief. We sincerely urge the Government of Karnataka to take concrete, corrective measures to help those in distress. Utmost priority should also be to penalize the builders and officials who have violated the law of the land with these projects.”

Early this month, members of Namma Bengaluru Foundation visited affected areas in all 8 zones of Bengaluru to spread a word on the fight for accountability and justice from the government. The organization received encouraging response from the people of Bengaluru, who want the State government to put an end to the menace of corruption, negligence and mal-governance.

Namma Bengaluru Foundation reaches out to BBMP demolition victims



Bengaluru, August 31, 2016: Namma Bengaluru Foundation volunteers along with their canters visited BBMP demolition affected areas across Doddabommasandra, Yelahanka, Atturu, Anantapura, Thirumenahalli, Ramachandrapura village and met hundreds of victims, who shared their grievances regarding the demolitions. Citizens also signed a petition to Chief Minister of Karnataka demanding: No double standards in demolishing illegal constructions, where rich and well connected are excluded, Compensation on Humanitarian grounds to the victims and the displaced who have homes with BBMP plan approvals and Prosecution without exception of All Guilty Government Officials and Erring Builders under all relevant sections of all Laws Violated.

The citizens positively connected with NBF and shared irregularities and illegalities in the demolitions. Bengaluru, August 29, 2016: Post the overwhelming response and whole hearted support received for the fight to stand up for those Demolished By Corruption organized at Town Hall on Saturday, Namma Bengaluru Foundation (NBF) has set up Namma Bengaluru Citizen’s Committee (NBCC) comprising eminent citizens and legal experts. The NBCC will review ALL land grabs, encroachments and illegalities reported, and forward as necessary to appropriate authorities – Government agencies, media and legal action.

Citizens can now reach out to the Namma Bengaluru Citizen's Committee at nbcc@namma-bengaluru.org and report the following:
1.       Information & details of all types of land-grabs & encroachments – Storm Water Drains, Lakes, Public Land & Illegal Constructions. 
2.       Any Evidence of Government Officials and Politicians involved in all such illegal activities.
Starting August 29, 2016, NBF will be reaching out to the victims of BBMP demolitions in affected areas through canters to allow citizens to connect with NBCC and report irregularities and illegalities in demolitions.

Citizens will also be able to sign the petition to the Chief Minister of Karnataka launched at the Citizens’ Event on #DemolishedByCorruption at Town Hall, Bengaluru on August 27.

Bengaluru, August 27, 2016: Hundreds of citizens today gathered at Town Hall to register their anger and protest against the BBMP demolitions and to demand justice and accountability from the government.  Participating in a programme by Namma Bengaluru Foundation, eminent citizens and residents spoke about the corruption in BBMP and how the corrupt govt officials and the land mafia have completely taken over the city and indeed the administration itself.

The citizens shared their concerns and experiences about corruption in BBMP and resolved to fight till the end and sign the petition by Namma Bengaluru Foundation and Rajeev Chandrasekhar, MP and move the court for justice and also launch a fight against government demanding accountability.

Key points made by Speakers at the event

Shri AT Ramaswamy, Convener, Anti Land Grabbing Action Committee

·          Govt is unable to protect Bengaluru from land mafia and builders lobby.

·         Govt officials are involved in looting the city and it is foolhardy to expect the same officials to protect the city.

·         The attempts of government to target poor and helpless citizens is barbaric, uncivilised and sparing the rich and wealthy. While the houses of poor were demolished without giving them any opportunity even to relocate, the rich and wealthy were given notices and now attempts are being to spare them.

·         The City needs people’s movement against corruption that has engulfed out city and I thank Rajeev Chandrasekhar for giving power / strength  to this movement.

·         Citizens silence means encouraging the corrupt officials and builders who have captured the government and the city.

Shri V Balasubramanian, Former Additional Chief Secretary of Karnataka, 

·          Unlike any city in the world, Bengaluru depends on its lakes. If the lakes don’t survive, Bengaluru won’t survive. The government should work towards protecting the lakes of Bengaluru.

·         It’s tragic to see that the government itself is breaching the laws that protect our lakes and build illegal construction on encroached lake beds. The government should follow the Supreme Court’s advice of creating a welfare fund out of heavy penalties, which may be imposed on erring builders who have misused the trust of homebuyers.

·         The government should also look to replace corrupt officials with honest and sincere ones, who are removed from office for supporting what is right for the citizens.”

Rajeev Chandrasekhar, MP

·         Determined to fight till the end. Will fight and support people for getting compensation and justice.

·         Appeal to all citizens to join the fight against corruption/ loot of the city and put pressure on government to identify and take action against all corrupt officials and guilty builders who connived to cheat the city and citizens.

·         The govt must not adopt double standards. They must not just target the poor and middle class while ignoring the big builders and rich and connected.

·         Corrupt officials and some builders are willing partners in looting and destruction of Bengaluru and this must be stopped and criminal prosecution against these must be initiated.

·         I will ensure the guilty and corrupt officials will go jail

Shri Krishna, Former Speaker of Karnataka Legislative Assembly

 ·          We are in the state of looters and not in democracy. We have lost Humanity and compassion. 

·         We should now unite and fight a legal and civic battle.

·         The govt does not have to device any measure to compensate the victims. Rather, just pay back the taxes and bills paid by them which is more than enough money for the victims to use and rebuild their life. 

·         It is high time to Invoke the summary enquiry clause and punish/ dismiss the corrupt officials. This should happen within 6 months and hence this committee should be created and action needs to be taken as the citizens do not have any more patience. 

·         While I have my doubts that the govt will even touch the builders, however what can be done it to bring transparency by way of publishing the maps in each and every ward.

Shri HS Doraiswamy, Senior Freedom Fighter

·          The demolitions are commendable however, its better late than never. All of us know that everyone is part of this nexus – People who have wronged must be punished and Jailed. 

·         Builders have been successful in demoralising the entire system and hence have clean records (Quoting CREDAI statement and arguments yesterday). 

·         Not knowing law is no excuse. However, citizens despite whatever may be the reason have been victimised and hence Govt has the obligation to compensate them. 

·         This is purely a humanitarian concern  and the Govt should find alternative place so these can be temporarily shifted till the time a solution is found. 

·         Citizens should wake up and get the Govt to provide Justice. 

·         The prerogative and the responsibility lies on citizens alone and so getting the Govt to compensate and punish the officials both are the responsibilities of them. This is “Namma Bengaluru” and hence we must fight to protect our city.

 Shri BN Vijayakumar, Jaynagar MLA 

·          BBMP action is  height of arrogance. 90% of the BBMP officials are the ones who are to be blamed. 

·         They know the art of tweaking any records. All you need to know how to buy them. 

·         This is Namma Bengaluru – but it hardly matters to the corrupt officials. 

·         The only way out for us is to join a Non-Political committee and fight for our compensation. No officials should be spared and shall be prosecuted/ punished

·         This will set a lesson to the future Govt/ officials to not take citizens lightly or cheat them.

Mr. Prithvi Reddy, convener, AAP

·         We are 1 crore citizens. Even 1% of this would rise and fight, there will be no escapades for the corrupt officials and greedy builders. 

·         Govt has a legal obligation where it has to acquire citizen’s property, then the Govt should pay double the price and hence we don’t have to beg them to compensate us but to get the Govt fulfil its legal obligation.

Shri Sajan Poovayya, Senior Advocate, Former Additional Advocate General for Karnataka answered to people’s query:

·          Everyone feels that going to court is waste of time and the justice will be delayed. However, Rajeev Chandrasekhar and Namma Bengaluru Foundation have proved this theory redundant with getting the NGT order and help Govt redeem 1 lakh acres of land and all this was possible because of the legal effort.

·         It must be a consorted effort with the social effort(like twin wheels of a fight). So do not hesitate to step forward a fight a legal battle.

·         Demolitions are happening basis a final map available with the BBMP. If you think that your property should not have been demolished as it is basis a false map/ Revoke the order then you should join the fight with NBF and file for a petition

Bengaluru, June 18, 2016: In a first of its kind initiative to help Bengaluru citizens understand and be aware of their rights, MP Rajeev Chandrasekhar and Namma Bengaluru Foundation will launch the Namma Hakku - Citizens Rights Series. The first in the series will be launched on Saturday, 3 pm at the Century Club with an interactive session and will focus on rights of the home buyers under the recently passed Real Estate Regulation Act – RERA and their rights against law breaking developers. A panel consisting of experts including retired high court judge, lawyers, citizen rights activists and others will interact with the citizens and home buyers, and help them understand RERA and their rights.

The interactive session with experts focussed on RERA comes as boon to home buyers in Bengaluru to understand their rights and be aware of the obligations of the builders to deliver on their promises. Eminent panellists who will explain RERA and interact with home buyers and answer their questions are Justice AV Chandrashekara, Former Hon’ble Judge of High Court of Karnataka, Shri Sajan Poovayya, Senior Advocate & Former Additional Advocate General for Karnataka, Shri Sunil Dutt Yadav – Advocate, Environmental Issues and RWAs, Professor Rajagopalan, Citizen Activist and Fellow, IIM-Ahmedabad and Shri Rajeev Chandrasekhar, Member of Parliament and Founder Trustee of Namma Bengaluru Foundation.

Citizen Action (CAF), Apartment Adda, CIVIC and BRACE – ensemble of more than 800 Resident Welfare Associations in Bengaluru will participate in the event.

Namma Hakku devoted to help citizens of their rights 

The Namma Hakku series is the brain-child of MP Rajeev Chandrasekhar, who has long fought for the rights of Bengaluru citizens and for protecting the city. The series is aimed to create a platform of engagements with citizens / consumers of Bengaluru to build awareness about their rights. Eminent panellists and experts interacting with the citizens and inform them about their rights.

While the first of the series will be launched this Saturday, June 18th, and focus on home buyers, the ongoing exercise will bring experts and citizens together to address various issues by citizens and information about how they can exercise their rights – be it protecting their neighbourhood, safety and law & order, environment among others.

RERA - Real Estate (Regulation and Development) Act,

Rajeev Chandrasekhar was the Member of the Select Parliament Committee that examined, worked on the Bill and played a key role in ensuing consumers rights of home buyers are protected and builders held accountable for their promises.

Key Features of RERA

1.       It is the most important pro-consumer legislation that the government has brought into Parliament, and seeks to protect thousands and millions of homeowner consumers in the real estate sector.

2.       The Bill formally enshrines consumer rights and builder obligations in law and also boosts the industry by creating a framework of competition, efficiency and investments for the sector.

3.       Victims of delayed delivery, poor quality, illegal constructions, fraud etc. Consumers were having to organise themselves into societies and groups to get any kind of justice or response or go through expensive, time consuming litigation to get any relief at all .

4.       This Bill will change the balance from builders to consumers - where small consumers have a better chance at holding builders accountable to their contractual commitments and promises.

5.       It creates rights for consumers, obligations for builders, Penalties for those who violate their obligations and creates a new independent, institutional framework of a Real Estate Regulatory Authority and an Appellate Tribunal that can fast track any dispute that arises between consumers and builders.
